If there’s a Will, the named Executors are responsible for applying for what’s called a Grant of Probate. If there’s no Will, a close family member may apply for Letters of Administration to take care of the estate.

When is probate required?
You’ll usually need a Grant of Probate (or Letters of Administration) if the person who passed away left:
- More than £5,000 in assets.
- Property or land.
- Stocks or shares.
- Certain insurance policies.
Some banks may waive this requirement for smaller estates, but most institutions will need to see legal documents before releasing funds.
What you need to do first
In the first few days, you’ll need to:
- Notify the person’s GP.
- Begin funeral arrangements (check the Will for wishes or prepaid plans).
- Register the death.
- Inform government departments or pension providers.
- Let friends and family know.
Soon after, you should:
- Find out if there is a Will.
- Contact the Executors or decide who will apply to handle the estate.
